Terms and Conditions

This course is delivered in an asynchronous online format and is designed to meet the education requirements established by the New York Department of State for real estate licensure.

Please read these Terms carefully before beginning the course. They explain course structure, expectations, policies, and support resources.


Course Final Exam and Proctoring

The New York 77-Hour Real Estate Salesperson Qualifying Course requires a proctored, school-administered course final exam.

License Essentials learners may use an approved in-person proctor. Finish From Home and License & Launch include remote course-final proctoring at no additional charge. Any fee voluntarily paid directly to an outside in-person proctor is separate from LearnCycle’s products.

The course final exam is distinct from practice exams and the New York State licensing exam.

Approved In-Person Proctors

Learners using the in-person path can review the Proctor Directory. LearnCycle does not guarantee the availability of any individual proctor listed. Scheduling is the learner’s responsibility.

For an in-person course final, the learner must present valid government-issued photo identification, and the approved proctor must complete the required attestation or authorization before launching the exam. The exam must be completed without unauthorized assistance and under the proctor’s direct supervision.

Proctoring Fees

Remote course-final proctoring is included in Finish From Home and License & Launch. LearnCycle does not control fees voluntarily charged by an outside in-person proctor, and those fees are the learner’s responsibility.

Access Period

License Essentials, Finish From Home, and License & Launch include two years of course and product access. For free enrollments, the two-year period begins on enrollment. For paid products, it begins on the purchase date.


Course Structure and Completion Requirements

To successfully complete this course, learners must:

  • Complete all instructional sections.
  • Complete all incremental quizzes.
  • Achieve a minimum score of 70% on each incremental quiz.
  • Complete the required proctored course final exam.
  • Satisfy all required seat-time and participation requirements.

Progression is mastery-based. Learners must achieve the required passing score before advancing.


Assessments

Each section includes:

  • Knowledge Check Quiz (30 questions drawn from a 90-question bank).
  • Case Study A Quiz (10 questions drawn from a 30-question bank).
  • Case Study B Quiz (10 questions drawn from a 30-question bank).

Questions are randomly selected from assessment banks. Immediate feedback is provided after each question, including explanations for correct and incorrect answers. Learners may retake quizzes as needed to achieve mastery.


Pass-the-First-Try Guarantee

License & Launch includes our Pass-the-First-Try Guarantee.

To qualify, complete LearnCycle’s Exam Prep Comprehensive Review and required practice tests during the fourteen (14) calendar days immediately preceding your scheduled New York Real Estate Salesperson state exam.

If you do not pass the state exam on your first attempt, LearnCycle will reimburse the fee for one state-exam retake after receiving reasonable documentation of your first-attempt result and retake-fee payment.

This guarantee reimburses one state-exam retake fee. It is not a refund of the License & Launch purchase price and does not guarantee licensure or passage on a later attempt.


General Disclaimer

LearnCycle does not guarantee licensure, employment, earnings, or passage of an examination, except for the limited reimbursement expressly provided by the Pass-the-First-Try Guarantee.


30-Day Refund Policy for Paid Products

LearnCycle will provide a full refund of the amount paid for an eligible paid product when both conditions are satisfied:

  1. LearnCycle receives the request within thirty (30) calendar days after the original purchase date.
  2. The learner has not started the required course final exam.

This policy applies to Finish From Home and License & Launch. Free products do not generate a refundable payment.

When the Course Final Exam Is Considered Started

For remote proctoring, the course final exam is considered started when the learner begins the Honorlock setup process or a billable Honorlock proctoring session is created, even if the exam questions have not yet been displayed.

For in-person proctoring, the course final exam is considered started when the proctor attestation or authorization is submitted or the exam is launched, whichever occurs first.

Viewing exam instructions or scheduling an in-person proctor does not count as starting the exam. Practice quizzes, practice final exams, and the separate New York State licensing exam also do not count.

For a bundle, starting the required course final exam for any included qualifying course ends refund eligibility for the entire bundle.

Processing

Requests must be sent to support@learncycle.com from the email address associated with the account. Approved refunds will be returned to the original payment method, and access to every paid component of the refunded product will be revoked.

Remote-proctoring fees are included in Finish From Home and License & Launch. Fees paid directly to an outside in-person proctor, government agency, or state testing provider are not refundable by LearnCycle.

Refunds may be denied for fraud, chargeback abuse, or material violations of the Terms, subject to applicable law. The refund policy in effect at purchase governs that purchase.


Academic Integrity

Learners must complete this course personally. Prohibited conduct includes:

  • Receiving unauthorized assistance.
  • Allowing another person to complete the course.
  • Misrepresenting identity.

Violation of academic integrity policies may result in termination and reporting to appropriate authorities.


Technical Requirements

To participate in this course, learners must have:

  • Reliable internet access.
  • A modern web browser.
  • The ability to complete online assessments.

2. Services

LearnCycle provides online educational courses, training programs, and related digital materials for informational and educational purposes only. Our content does not constitute legal, financial, professional, or medical advice.

3. Account Registration

To access certain Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your login credentials.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Payments and Pricing

All prices are listed in U.S. Dollars unless otherwise stated. You agree to pay all fees associated with your purchase at the time of checkout. Pricing and course availability are subject to change at any time, but changes will not affect purchases already completed.

5. Refund Policy

The 30-Day Refund Policy for Paid Products stated above is incorporated into these Terms.

6. Intellectual Property

All content provided through the Services, including videos, text, graphics, logos, course materials, and software, is the property of LearnCycle or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the content solely for personal, non-commercial educational purposes. You may not:

  • Copy, reproduce, distribute, sell, or sublicense any content.
  • Share course access or login credentials.
  • Modify, reverse engineer, or create derivative works.

7. Prohibited Conduct

You agree not to:

  • Use the Services for unlawful or unauthorized purposes.
  • Interfere with or disrupt the operation of the Services.
  • Attempt to gain unauthorized access to systems or accounts.
  • Upload or transmit malicious software or harmful content.

Violations may result in immediate termination of access without refund.

8. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. LearnCycle makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or results of the content provided.

LearnCycle does not guarantee licensure, employment, earnings, or passage of an examination, except for the limited reimbursement expressly provided by the Pass-the-First-Try Guarantee.

9. Limitation of Liability

To the maximum extent permitted by law, LearnCycle shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability shall not exceed the amount paid by you for the applicable course or service.

10. Indemnification

You agree to indemnify and hold harmless LearnCycle, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, or expenses arising from your use of the Services or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Services at our discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful to LearnCycle or other users.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after any changes are posted constitutes acceptance of the revised Terms.
